Comedian Tracy Morgan is suing Walmart over a deadly limo bus crash on the New Jersey Turnpike that left him critically injured. The complaint was filed Thursday in the U.S. District Court in New Jersey.
Morgan, 45, suffered broken ribs, a broken nose and a broken leg in the crash in the early morning hours of June. His friend and fellow comedian James McNair was killed and others were injured.

The Walmart truck that rear-ended Morgan’s limo bus was traveling 20mph over the speed limit and the truck driver was almost at his drive time limit, according to a preliminary report by the National Transportation Safety Board.

According to the complaint filed by lawyers acting for Morgan and three others, the truck driven by Walmart employee Kevin Roper collided with the rear end of Morgan’s vehicle.

“The defendants’ negligence was a substantial contributing factor in causing plaintiffs’ injuries,” the complaint states. Kevin Roper, from Jonesboro, Georgia, pleaded not guilty last month to criminal charges that include vehicular homicide and assault by auto.

Tracy Morgan is a well known actor that has participated in movies, television and stand ups across the world. Morgan was a regular on “Saturday Night Live” for seven years and later received an Emmy nomination for his role in the comedy series “30 Rock.”

Tracy Morgan was released at the hospital on June 20th and transferred to an undisclosed rehab center where we’ll continue to rehab from all his injuries. “While he is continuing to show signs of improvement, he still has a long way to go,” his rep said in a statement. “He and [his fiancée] Megan wanted to publicly express their deepest gratitude to everyone at Robert Wood Johnson University Hospital for the unbelievable care and attention they provided him.”

David Jay Glassman, Roper’s lawyer, added that he and his client will not be speaking out about rumors or speculation, and believe that Roper will be acquitted in court. “We remain mindful of the victims and continue to express our deepest sympathies to the family of James McNair and our heartfelt wishes for a full recovery of those who suffered injuries in the accident,” he added.

The New York City native made his reputation with over-the-top characters and impressions of celebrities such as Mike Tyson and Oprah Winfrey. Morgan is considered to be one of the funniest actors in the world. The accident instantly changed his course in life but we feel confident that Tracy Morgan will make a full recovery and will continue his legendary career soon.
